El Mercado Fresco on Metro AVE in Kansas City fouls inspection; 13 violations, hundreds of small flies found swarming over dry onion storage and throughout backroom area

Kansas Department of Agriculture’s (KDA) food safety and lodging program conducted an unannounced retail food inspection on 8/24/2020. As a result of that inspection, and due to the severity of the specific violations the El Mercado Fresco was cited as being, “Out of Compliance” with Kansas food safety regulations. During this inspection a total of 13 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • In produce coolers on sales floor, three packages of strawberries found with mold growth. COS, PIC voluntary discard. In produce bins on sales floor, four moldy and spoiled peaches found. COS, PIC discarded. In bakery prep-room reach-in cooler carton of tres leches milk product had no date marking. PIC did not know when it had been opened. COS, PIC discarded. In seafood service case, two packages of reduced oxygen packaged tilapia fillets with no slit cut into packaging. PIC stated they had been placed under refrigeration to thaw 24 hours ago. Less than 48 hours. COS. PIC decided to discard.
  • Packages of RTE tamales offered for sale with no label. PIC stated the tamales were made in a private home and brought to establishment for sale. COS, PIC discarded and adulterated tamales.
  • On sales floor, twelve cans found with substantial dents and deformations compromising the integrity of the can’s seal. COS, PIC voluntary discard.
  • In open case meat cooler on sales floor, packages of raw ground turkey stored next to and in contact with cooked RTE turkey wings. No leakage evident. COS, PIC rearranged and installed dividers. In walk-in meat cooler, on metal shelving, raw pork stored over cooked RTE pork blood sausage. No leakage evident. COS, PIC rearranged. In seafood service case, container of seafood medley containing raw squid stored over container of cooked RTE peeled shrimp. No leakage evident. COS, PIC rearranged. In open case meat cooler on sales floor, packages of raw pork bacon stored next to and in direct contact with cooked RTE hot dogs. In same cooler, packages of raw pork bacon also stored over cooked RTE hot links. No leakage evident. COS, PIC rearranged. In open case dairy cooler on sales floor, packages of raw salted pork stored above packages of cooked RTE mozzarella. No leakage evident. COS, PIC rearranged. In open case meat cooler on sales floor, packages of raw pork sausage stored above packages of RTE cheese. No leakage evident. COS, PIC rearranged. In walk-in cooler of meat prep area, container of raw chicken wings stored above containers of raw shrimp ceviche. No leakage evident. COS, PIC rearranged.
  • In walk-in meat cooler, on metal shelving, raw marinated chicken wings stored over raw pork chorizo. No leakage evident. COS, PIC rearranged. In open case meat cooler on sales floor, packages of raw ground turkey held over raw pork, and raw chicken wings held over raw pork ribs. No leakage evident. COS, PIC rearranged.
  • On sales floor, in open case deli cooler, queso fresco cheese wheels held at 48F. COS, PIC discarded. Educated that overfilling display cases leads to poor circulation of chilled air, reducing effectiveness of refrigeration. On sales floor, in open case dairy cooler, packages of shredded mild cheddar cheese stored at 44F. Educated. COS, PIC discarded. Educated that overfilling display cases leads to poor circulation of chilled air, reducing effectiveness of refrigeration.
  • In open refrigerated case on sales floor, packages of prepared-on-site pinto beans, green salsa, red salsa, and guacamole bore no preparation date mark. PIC stated the salsas and guacamole were made yesterday than 24 hours ago. PIC stated beans were made on 8/21, greater than 24 hours ago. COS, PIC labeled with accurate preparation date.
  • In deli service case, packages of commercially prepared cheese and cooked RTE ham marked with “prepared by” date of 8/23, and “use by” date of 8/30. Dated with a duration greater than 7 days. COS, PIC relabeled items to reflect accurate discard date.
  • In seafood service case, raw shrimp ceviche offered for sale with no consumer advisory for raw or undercooked food. COS, PIC will print consumer advisory disclosure and reminder and post it on service c
  • On clean dish shelving in bakery two stored as clean rubber spatulas found with visible food debris and one stored as clean metal strainer with visible food debris. COS, PIC removed for ware washing.
  • On sales floor in bakery area, metal tongs used for self-service of bakery items stored at room temperature. PIC stated they are cleaned once a day. Educated. COS, PIC stated they would no longer use tongs and would begin using deli sheet paper immediately.
  • In backroom dry storage area, hundreds of small flies found swarming over dry onion storage and throughout backroom area. PIC stated pest control operator servicing location.
  • In bakery prep area, clear spray bottle with blue liquid bore no label. PIC stated it was kitchen sanitizer. COS, PIC labeled bottle with name of contents.
  • In back dry storage, bottle of chlorine bleach stored above barrel of rendered pork skin fat. No leakage evident. COS, PIC removed.
  • On front register product display, bottles of chemical hand sanitizer stored above packages of chewing gum. COS, PIC rearranged.
