The Kansas of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on 2/11/2020. As a result of that inspection, and due to the severity of the specific violations the El Mezcal III restaurant in Topeka was cited as being, “Out of Compliance” with Kansas food safety regulations. During this inspection a total of 10 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • In the kitchen, in the warmer made on site queso cheese 88F. Person in charge said the queso cheese was taken from the walk in cooler and placed in the warmer around 10:00 am today. The cook placed the queso cheese on the stove top to reheat to 165F. The queso cheese was reheating on the stove top in a pan of water. At about 12:20 PM the queso cheese was at 148F. The queso cheese did not reheat to 165F in 2 hours. This is a repeat violation. 
  • In the kitchen, in the hot box the following items were not held to 135F: a pan of refried beans 128F and 131F. The cook said the beans were prepared this morning and placed in the hot box about 10:30 am. Time temperature was taken was 11:15 am today. Corrected onsite; refried beans were reheated on the stove top to 167F. Rice in the hot box was at 195F. This is a repeat violation.
  • In the walk in cooler, made on site tamales were without a date mark. An employee said the tamales were placed in the walk in cooler on Thursday (2/6) and removed from the walk in freezer and placed in the walk in cooler yesterday (2/10). In the kitchen, in the refrigerated prep table a pan of made on site chile relleno were without a date mark. An employee said the chile rellenos were prepared yesterday (2/10) around 11:00 am. Time of the inspection was 11:30 am. Corrected on site-the above items were correctly dated. This is a repeat violation. 
  • In the server station, in the 2 door reach in cooler a manufactured can of whipped topping was without a date mark An employee said he thought the whipped topping was opened 2 days ago (2/9). Corrected on site-employee wanted the whipped topping discarded. This is a repeat violation. 
  • The establishment serves eggs and steaks to order on the Huevos Rancheros. There is no * on the menu item. Corrected on site-A consumer advisory handout was filled out and posted. This is a new violation.
  • In the kitchen, the following items were stored as clean with dried on debris on the food contact surface: On a magnetic knife strip on the north wall-2 knives Mounted on the prep table on the north wall, the cutting blade of the commercial can opener. 1 pan stacked with sticker residue. Corrected on site-all of the above items were placed at the mechanical dish machine. This is a repeat violation.
  • In the kitchen, at the kitchen hand washing sink an employee was filling a pan with water. The water was going to be used for cooking. Corrected on site-education was provided on using the hand washing sink for hand washing only. This is a repeat violation.
  • No paper towels or other hand drying provisions at the bar hand washing sink. Corrected on site-paper towels were placed in the dispenser at the hand washing sink. This is a repeat violation.
  • In the food prep area near the walk in freezer, a spray bottle with oven cleaner in it had the spray nozzle pointing at the food contact surface of metal pans. Corrected on site-spray bottle was correctly relocated.
  • In the kitchen, on the wire shelf with the dry goods and containers of chips there was a spray bottle labeled peroxide with the bottle and spray nozzle over an uncovered container of chips. Corrected on site-peroxide was correctly relocated. This is a new violation.
