The Kansas of Agriculture’s Bureau of Food Safety and Laboratory Services conducted an unannounced retail food inspection on 2/18/2020. As a result of that inspection, and due to the severity of the specific violations the Dairy Queen in Gardner was cited as being, “Out of Compliance” with Kansas food safety regulations. During this inspection a total of 7 violations were found.

The inspector made the following comments in support of the violations found during the inspection:

  • In the kitchen a female employee wearing single use gloves, placed raw hamburgers on the grill and without removing gloves and washing hands proceeded to make a cheeseburger, touching the bun, cheese slice and cooked hamburger. Corrected on site: employee removed gloves, washed hands and put on new single use gloves. The cheeseburger was voluntarily discarded. Education provided on handwashing.
  • In the kitchen prep table next to the hot holding unit, hot cheese sauce was held at 109 F. Employee said sauce was put on the hot dispenser at 10:30 am. Time temperature was taken 1:10 PM, <4 hours. Corrected on site: cheese sauce was reheated to 165 F within 30 minutes. In the kitchen table next to the fryer, prepared on site gravy was held at 126 F. Employee said gravy was made at 11:00 AM. Time temperature was checked was 1:21 PM, < 4 hours. Corrected on site: gravy was reheated to 166 F within 30 minutes. Education on hot holding provided.
  • In the ice cream service area, ice cream mix under refrigeration was held at 47 F. The ice cream refrigerator/dispenser atmosphere temperature was 48 F. Corrected on site: ice cream mix was voluntarily discarded. Person in charge will call for repair. Facility will use the other ice cream refrigerator until the unit is repaired.
  • In the kitchen reach in cooler, an open package of hot dogs was date marked to be used by 2/16/20. Today is 2/18/20. Hot dogs were opened on 2/10/20. Corrected on site: hot dogs were voluntarily discarded.
  • On the dish rack, stored as clean, two plastic pans and 6 small plastic pans had sticker residues on the food contact surface. Corrected on site: dishes were moved to be be washed and sanitized. On the prep table, a tomato dicer had dry tomatoes pieces on the food contact surface. Corrected on site: tomato dicer will be washed and sanitized.
  • In the ice cream service area, the three compartment sink water temperature reached only 70 F. Sink won’t be used for dishes until repair is done. Will use only the three compartment sink in the back.
  • In the front ice cream serving area, a bucket with clear liquid was not labeled. Employee said liquid was sanitizing solution. Corrected on site: bucket was labeled with the common name.
